Virtually all wage and salary earners in Australia have employer-funded superannuation. Super now forms part of a couple's joint property and can be divided. This may seem easy, but be aware: superannuation can be subject to taxation when accessed. Tax can easily be overlooked, resulting in an unfair division of assets.
Many super schemes provide "defined benefits" either as lump sums or pensions. The Family Law Legislation Ammendment (Superannuation) Act 2002 recognises about 20 different types of super fund. These funds are more difficult to evaluate and require expert assessment.
The tax savings from a well-structured division of a superannuation fund can be very considerable. This means simply that more money is available to divide between the parties.
